A third underage boy has come forward claiming Utah teacher Briane Altice had a sexual affair with him back in 2013.
Altice, 35, was a teaching assistant at Kaysville High School before she was arrested in October of 2013 on suspicion of having sex with a 16 year-old boy. A second student accused her in August of this year of having an affair with him as well.
The latest victim is a 17 year-old boy who says he had a series of sexual encounters with Altice from August to September of 2013.
Altice lost her job and saw her marriage breakup after her arrest. She has since been charged with 10 felony counts including first-degree rape, first-degree sodomy and second-degree forcible sexual abuse. Through her attorney, Edward Brass, Altice has denied having sex with any of the boys.
“It is her defense that they did not happen at all,” Brass wrote in a motion. “That she never engaged in any inappropriate contact with either of her students …”
Prosecutors, however, claim that Altice admitted to police on two occasions that she engaged in sex with the 16 year-old original victim. Brass rebuts that these statements were coerced after officers threatened to take away Altice’s children.
“Her statements were coerced and involuntary and were taken in violation of her so-called Miranda rights,” Brass wrote in court papers. “The evidence she provided was the product of that tainted statement.”
Back in September one of her victims testified that their affair began with kissing between class periods, and escalated to sexual intercourse. When asked how he would describe his relationship with Altice, the boy replied, “teacher with benefits.”
