A Virginia teen who’s facing child pornography charges is saying that police aren’t satisfied with the photos they’ve already taken of his genital and now want to photograph his penis while it’s erect – and they’re willing to use force if necessary.
17-year-old Trey Simms was charged with manufacturing and distributing child pornography in January after being accused of sending an explicit video of himself to his 15-year-old girlfriend by police. Now the Manassas High School student is facing possible jail time and being placed on a sex offenders list for the rest of his life.
To make matters worse for the teen, his lawyer is saying that authorities want to force him to become aroused by using a drug injection so they can photograph his penis and compare it to the one in the video.
Simms’s trouble started when the mother of the girl, who was 15 at the time, caught on to the pair exchanging texts with each other and complained to police. Police then confiscated Simms’s iPad and iPhone and discovered the video.
Unsatisfied with the evidence they had, police worked even harder to gather evidence against him and in the process humiliated him, according to his aunt Stacy Bigley.
“He said they took him to a room and took pictures of his genitalia,” she said with tears in her eyes. She also claimed that Simms had tried to initially refuse the photographs, but that police threatened to do it by force if he didn’t comply.
Simms’s defense attorney, Jessica Harberson Foster, said that the prosecution is seeking more evidence against her client and will use force once again to obtain it. They’re seeking the photos of his erect penis, and when she asked them how they planned to get the photos, the prosecutor replied “We just take him down to the hospital, give him a shot and then take the pictures that we need.”
Since a magistrate has already signed off on the second search warrant Simms won’t have much of a choice. However Foster swears she’s going to fight it.
“This is a 17-year-old who goes to school every day, plays football, has never been in trouble with the law before,” she explained. “Now he’s saddled with two felonies and the implication that he’s a sexual predator,” she added.
“I don’t want him to go through that. Taking him down to the hospital so he can get an erection in front of all those cops, that’s traumatizing.”
Foster is also demanding to know why Simms is the only one being charged in the case, since both teens are underage and both sent photographs.
“From what I gather, there’s no intention to charge and this was handled inefficiently,” she said.
