BREAKING: Major Victory for Sheriff Joe

Reason number #5Million to love love love Sheriff Joe! His lawsuit against President Obama, has been expedited by the US Court of Appeals. In case you have been asleep, this lawsuit is designed to halt the president’s executive action on amnesty. Go get ’em, Joe!


The deadline for Arpaio’s brief is January 29th, and the administration has to respond by March 2 with a defense.
The order reads:
“Due to the expedited nature of this case, the court will not entertain dispositive motions. The parties should therefore address in their briefs any arguments otherwise properly raised in such motions,”

Larry Klayman, Sherriff Joe’s attorney in the case, sings praises:
“It is a big victory [for] Sheriff Arpaio and, indeed, the American people that the D.C. Circuit recognized the need for this case to be quickly resolved before Obama’s unconstitutional amnesty program goes into full effect this spring . There are constitutional issues of great magnitude at stake, and we are confident that the D.C. Circuit will put a legal stop to this illegal activity, which seeks to end-run congressional authority,”

Many would say the D.C. Circuit Court is arguably the second most powerful in the nation, right under the Supreme Court.

Arpaio bases his claims on his job as a sheriff on a border town near the U.S.-Mexico border. He alleges that he will be harmed by the large number of criminals allowed to remain in the US under the president’s executive action. He’s also argued that large parts of the amnesty plan have already taken effect. He also feels a lower court improperly dismissed his claim, and the time-sensitive nature of the lawsuit was a major argument in getting an expedited court date.

“This act by the president will have a serious detrimental impact on my carrying out the duties and responsibilities for which I am encharged as sheriff,” Arpaio said.

“Specifically, if a preliminary injunction is not swiftly entered, Obama’s illegal executive actions will severely strain and cause severe harm to our crime-fighting resources, both in manpower and financially,” he argued.
“Time is of the essence, since the brunt of Obama’s amnesty will occur in February,” Klayman added.
“By his own admission 22 times in the past, Obama lacks the power to take this unconstitutional executive action,” Klayman said. “To allow this to stand would amount to trashing our constitutional republic and set a bad precedent for future presidents.”
